Bos Commerce / Terms of Service

Terms of Service

Last updated

These terms apply between Bos Commerce ("we", "us") and you, the person or business that opens and runs a store on Bos Commerce ("you"). By creating a store you agree to them. Your shoppers are not party to these terms: your store's own terms and policies apply to them.

1. The service

Bos Commerce lets you open and run an online store: we host your storefront and its dashboard, keep them secure and up to date, and provide the features described on our website. Features may change over time; we will not remove a core part of the service you pay for without notice.

2. Your account

  • You sign in with your Google account and may invite team members, each with their own Google account. You are responsible for what happens under your store's accounts and for giving each person only the access they need.
  • You must be at least 18 years old, or the age of majority where you live, and able to enter into a contract for yourself or the business you represent.
  • The information you give us, such as your email address and billing details, must be accurate and kept up to date.

3. Your store and what you sell

  • You decide what you sell and you are the seller to your shoppers. You are responsible for your products, their descriptions and prices, delivery, returns, customer service, and the taxes and laws that apply to your sales, including consumer protection and the rules of the countries you ship to.
  • You must not use Bos Commerce to sell or promote anything illegal, counterfeit or dangerous, to infringe anyone's rights, to deceive shoppers, to send spam, or to attack or overload our systems or anyone else's.
  • Your store needs its own terms, refund policy and privacy policy for your shoppers. We provide drafts in your dashboard; you are responsible for completing them and for what they say.

4. Payments from your shoppers

Your shoppers pay you through the payment accounts you connect (Stripe, PayPal, a payment gateway) or by bank transfer to your accounts. Your agreement with each payment provider is between you and that provider, and their fees are yours. We never hold your money and take no commission on your sales.

5. Plans, trial and billing

  • Every new store starts with a free trial of 14 days. To keep your store open after it, you pay the plan you chose.
  • Plans are billed monthly, in advance. The invoice for each month is issued 7 days before your paid period ends and is due on its last day. You can pay it online through our payment gateway or by bank transfer.
  • If an invoice is still unpaid 7 days after its due date, your store is paused (it shows a notice instead of its pages) until the invoice is paid. Paying it reopens your store.
  • You can change your plan from your dashboard; the new plan starts with your next billing period. If you exceed a limit of your plan, such as its number of products, you may need to move to a larger plan to keep adding.
  • Prices are shown on our pricing page. We will tell you at least 30 days before a price change applies to you. Amounts already paid are not refunded when you close your store before the end of a period, unless the law requires it.

6. Your content

Everything you put in your store (products, pictures, texts, your shoppers' data) remains yours. You give us the permission we need to host, copy, process and display it in order to run your store and the service, and you confirm that you have the rights to it. We do not claim ownership of it and do not use it for anything else.

7. Data and privacy

Our privacy policy explains how we handle your personal data. For the personal data of your shoppers, you are responsible as the store, and we process it on your behalf only to run your store: we keep it confidential, protect it, keep it separate from every other store, and do not sell it or use it for our own purposes.

8. Availability and changes

We work to keep Bos Commerce available and fast, but we cannot guarantee that it will never be interrupted, for example during maintenance, when a service we rely on fails, or for reasons beyond our control. We may change or improve the service; when a change materially reduces what you rely on, we will tell you in advance.

9. Closing your store, suspension and termination

  • You can close your store at any time from your dashboard. It goes offline at once and nothing more is billed; its data is kept until you ask us to delete it, so that you can reopen it or take a copy.
  • We may suspend or close a store that breaks these terms, puts shoppers or other stores at risk, or remains unpaid, after telling you why when we reasonably can. For serious or illegal misuse we may act at once.

10. Liability

Bos Commerce is provided as it is. To the extent the law allows, we are not liable for lost profits, lost sales or indirect damage, and our total liability for any claim is limited to the amounts you paid us in the 12 months before it arose. Nothing in these terms limits liability that cannot be limited by law.

You are responsible for claims that arise from your products, your store's content or your dealings with your shoppers, and will compensate us for reasonable costs we incur because of them.

11. Changes to these terms

We may update these terms. When a change is significant we will tell you by email or in your dashboard at least 30 days before it applies; if you do not agree, you can close your store before then.

12. Law and disputes

These terms are governed by the laws of the Republic of Indonesia. We will first try to settle any dispute with you in good faith; if we cannot, it will be resolved by the competent courts of Indonesia, unless the law of your country gives you the right to another forum.
